BOOKING TERMS & CONDITIONS

Founder-Led Trip, Morocco 2019

Naya Traveler is defined to include its owners, agents, directors, officers, employees, representatives, and affiliates, (collectively “Naya Traveler”). By booking a trip with us, you are agreeing to these Booking Terms & Conditions, which constitutes the entire agreement between you and us.

I. TRIP CONFIRMATION AND PAYMENT DETAILS

Naya Traveler accepts credit cards, wire transfers and PayPal transactions as acceptable methods of payment. Once the deposit or full payment is processed, we will send you a confirmation e-mail of receipt of payment and a welcome packet by mail with details about the trip you have booked.

II. TRAVEL INSURANCE

Travel insurance is compulsory for all of our travelers, and proof of said insurance must be provided before the first day of the trip. Travel insurance must provide coverage against personal accident, death, medical expenses, and emergency repatriation with a minimum recommended coverage of USD $100,000 in personal injury and USD $200,000 in repatriation and evacuation expenses. It is also strongly recommended that it covers cancellation, curtailment, personal liability, and loss of luggage and personal effects. Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses should your trip with Naya Traveler be cancelled for any reason. It is your responsibility to verify your insurance policy details with your insurance provider to ensure Naya Traveler’s requirements are satisfied.

III. DEPOSIT REQUIREMENT

In order to reserve a spot on the Founder Led Group Trip, a deposit of  $1,990 per person is due to secure the trip. If the booking is made within 90 days of the trip departure, full 100% payment is due.

IV. FINAL PAYMENT REQUIREMENT

The balance payment is due 90 days before departure. If the payment is not received by the due date, rates and trip availability cannot be guaranteed. If the booking is made within 90 days of the trip departure, full 100% payment is due.

V. CANCELLATION BY THE TRAVELER

Any cancellation by the traveler must be requested in writing and must be acknowledged by Naya Traveler in writing. Cancellation +91 days prior to the trip departure: 50% of the deposit will be refunded. Cancellation 90-60 days prior to the trip departure: the balance is refunded and the deposit is retained. Cancellation 59 - 0 days prior to the trip departure: both the deposit and the balance are retained. 

VI. CANCELLATION BY NAYA TRAVELER

Should Naya Traveler deem it necessary to cancel the scheduled trip after payments from the traveler have been received, payment will be refunded or applied towards a future Naya Traveler trip. In circumstances where the cancellation is due to external events outside our reasonable control, refunds will not include any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including, but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

VI. TRIP & ITINERARY CHANGES

Naya Traveler itineraries are fully custom-made and changes can be made to any given itinerary prior to the deposit payment, subject to availability and feasibility. Once the deposit or full payment is made to Naya Traveler by the traveler, we will make every effort to accommodate the requested changes. However, Naya Traveler reserves the right to increase the price of the trip, depending on the extra costs that the changes may incur.

VII. YOUR INFORMATION

In order to for us to confirm your travel arrangements, you must provide all requested personal details, including a face copy of your passport, legal name, date of birth, passport number, passport country and expiry date, and your home address. Your booking cannot be confirmed without these details.

VIII. AGE & HEALTH REQUIREMENTS

All travelers must be 18 years of age or older unless they are accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18.

It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

IX. OPTIONAL ACTIVITIES

During a Naya Traveler trip, there may be opportunities to participate in activities or local events, which are not included in Naya Traveler’s trip. Naya Traveler makes no representations about the safety or quality of these activities and events, or the standard of the independent operator running it. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

X. PASSPORT & VISAS

Passports are required to travel to all Naya Traveler destinations. The traveler is responsible for obtaining the required tourist visa and/or legal documentation to enter the destination. Check with the appropriate consulate or embassy for the latest visa requirements. Your passport must be valid for 6 months beyond the duration of your trip. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.

XI. ACCEPTANCE OF RISK & WAIVER

You are responsible for purchasing the style of trip that fits your desired comfort level and participating in activities that are suitable for your fitness level and capabilities. Naya Traveler will customize your trip based on the personal information and preferences you provide to the company. By making a booking, you acknowledge that Naya Traveler’s trips are adventurous by nature and may involve a significant amount of personal risk. You are aware that travels such as those which you are undertaking involve hazardous activities, some in remote areas of the world, with a risk of injury or death which may be caused by forces of nature, the negligence of Naya Traveler, or other persons and companies known or unknown, or of willful or criminal conduct of third parties. You are also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which you are participating in this trip.

You accept these risks and obligations and fully assume the risks of travel and work in this type of environment. You fully and forever release and discharge Naya Traveler and all other related, affiliated, associated or otherwise connected corporations, partnerships, individuals and other entities and all of their respective officers, directors, employees, contractors, agents, successors and assigns (collectively, the “Releasees”) from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all losses, damages, death or injuries to persons or loss of property, which may be sustained by you in connection with or in any way relating to this trip, due to any cause or reason whatsoever including, without limitation, the reckless, willful or negligent actions or omissions of the Releasees or any other person or persons.

 

XII. PERSONAL RESPONSIBILITY

You acknowledge that neither you nor anyone traveling with you has any physical, mental, or other conditions or disabilities that would create a hazard to yourself or your group members. Naya Traveler reserves the right to decline anyone from joining a trip with justifiable cause. Naya Traveler also reserves the right to remove you from a trip if you are creating a hazard to yourself or others, impacting the enjoyment of others, or participating in any illegal activity. Any costs resulting from being removed from a trip or being declined participation in a trip is at your expense.

XIII. TRAVEL ADVISORIES & WARNINGS

The safety of our travelers, leaders, and operators is a major priority of Naya Traveler. With this in mind we monitor world events very closely. Naya Traveler makes operational decisions based on informed advice from a number of sources. Although we continually monitor the areas we visit, it is your responsibility to stay informed about the areas where you will be traveling to including any travel advisories and warnings issued by your country’s government. You are responsible for protecting your own well-being and personal property before, during, and after your Naya Traveler trip. This includes ensuring any and all vaccinations, inoculations, or prescribed medications are taken as directed by your local doctor and/or travel clinic for the areas visited.

XIV. SEAT BELT POLICY

To ensure the safety of our Travelers and staff, Naya Traveler recommends that everyone wear their seatbelts at all times while riding in any vehicle that is in motion. This recommendation is not only for your safety but also for the safety of everyone else in the vehicle. It is noted that some vehicles internationally may not be equipped with these restraints as accepted by local laws. Naya Traveler and our transportation suppliers remain focused on protecting your safety, but they cannot be expected to constantly check to make sure everyone is buckled prior to moving a vehicle. Therefore, it is your responsibility to wear your seatbelt properly and at all times while the vehicle is in motion.

XV. CULTURAL DIFFERENCES

It is acknowledged and understood that traveling to Naya Traveler’s destinations will expose travelers to unique situations and experiences that may differ from those you are familiar with in your home country. We believe that these differences enhance the experience and add adventure to a trip. Naya Traveler will discuss these differences before your trip, but you also have a responsibility to perform your own research and act responsibly while traveling.  

XVI. LIABILITY RELEASE

Naya Traveler does not own or operate any entity which is to or does provide goods or services for your trip including, for example, ownership or control over hotels or other lodging facilities airline, vessel, bus, van, or other transportation companies, local ground operators, providers or organizers of optional excursions, food service or entertainment providers, etc. Naya Traveler is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of nature, acts of God, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, structural or other defective conditions in hotels or other lodging facilities, mechanical or other failure of airplanes or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely, dangers associated with animals, marine life or vegetation of any sort, dangers incident to recreational activities such as scuba diving, snorkeling, swimming, kayaking, sailing, canoeing, rafting, hiking, bicycling, rock climbing, etc., sanitation problems, food poisoning, lack of, access to or quality of medical care, difficulty in evacuation in case of medical or other emergency, or for any other cause beyond the direct control of Naya Traveler.

XVII. MEDIA RELEASE

You hereby consent and agree that Naya Traveler, it’s employees, officers, and agents reserve the right to take photographs or digital recordings of you from any Naya Traveler trip/event/activity and to use these in any and all media, now or hereafter known, and exclusively for the use of Naya Traveler. You do hereby release to Naya Traveler, its agents, and all employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. You waive any rights, claims, or interest you may have to control the use of your identity or likeness in whatever media used. You understand that there will be no financial or other remuneration for recording you, either for initial or subsequent transmission or playback.


XVIII. PRIVACY POLICY

Naya Traveler is committed to protecting the privacy and confidentiality of your personal information. Any personal information that we collect about you may be used for any purpose associated with the operation of your trip or to send you marketing material in relation to our events and special offers. The personal information may be disclosed to our service providers or other suppliers to enable us to operate the trip.  We will otherwise treat your details in strict accordance with our privacy policy (available for viewing on our website).

XIX. APPLICABLE LAW

The State of Maryland law governs these Terms and Conditions to the fullest extent allowable. Any disputes in connection with a Naya Traveler trip or these Terms and Conditions will be initiated in the Superior Courts of the State of Maryland where exclusive jurisdiction and venue reside. If a court or any other appropriate authority finds any portion of this document to be invalid, the remainder will remain in full force and effect.

XX. UPDATING BOOKING TERMS & CONDITIONS

Naya Traveler reserves the right to update and/or alter these Booking Terms & Conditions at anytime, and it is the traveler’s responsibility to be familiar with them. The latest Booking Terms & Conditions can always be found on the Naya Traveler website www.nayatraveler.com and will supersede any previous versions.
